NASCAR indefinitely suspends driver Kurt Busch

   NASCAR on Friday indefinitely suspended Sprint Cup Series driver Kurt Busch after a Kent County (Del.) Family Court commissioner issued his opinion detailing the domestic violence acts allegedly committed by Busch against his ex-girlfriend Patricia Driscoll.

   The Observer first reported the suspension on Friday afternoon.

   "Given the serious nature of the findings and conclusions made by the commissioner of the Family Court of the State of Delaware, NASCAR has indefinitely suspended driver Kurt Busch, effective immediately," a NASCAR statement said. "We will continue to respect the process and timetable of the authorities involved."

   Xfinity Series driver Regan Smith will replace Busch in Stewart-Haas Racing's No. 41 Chevrolet in Sunday's Daytona 500, the team confirmed. 

   In his order on Monday, Kent County (Del.) Family Court commissioner David Jones found "by a preponderance of the evidence" that Busch committed an act of domestic violence against Driscoll.

   On Friday in a 25-page written opinion, of copy of which has been obtained by The Observer, Jones said he believed Busch "manually strangled" Driscoll in a confrontation in his motorhome on Sept. 26, 2014. The commissioner also believed there was "substantial likelihood" Busch could commit similar matters in the future.

   The commissioner also found that Driscoll provided "false testimony" at times during the hearing but believed enough independent evidence existed to find merit in Driscoll's claim.

   Driscoll sought the order after alleging Busch smashed her head against the wall of his motorhome three times during last September's NASCAR race weekend at Dover, Del. 
   
   The Dover (Del.) Police Department investigated Driscoll's complaint but elected to send its findings to the Delaware Attorney General with no recommendation. The Attorney General's office has yet to decide whether to seek any criminal charges against Busch.

   Among the restrictions placed on Busch by the order: 

   - Busch cannot threaten, molest, attack, harass or commit any other act of abuse against Driscoll and any minor children in her household.

   - Busch cannot come with 100 yards of Driscoll's person, residence or workplace. At NASCAR races, Busch must maintain a "practicable distance" from Driscoll if both are in attendance. 

    - Busch cannot attempt to contact Driscoll in any way.

   - Busch must be evaluated for "mental health problems" and follow any recommendations by the evaluator.

  3. I might not believe the charges had it not been for Kurt's past temper flare ups. Tons of talent waisted. I forsee a year away from Nascar. Use that time Kurt to heal yourself. Perhaps seek wise spiritual advise to help you come back a better man in many ways. It may be hard to immediately get back with a major team if you have to be out of racing for entire season. With your talent, however, and being upfront about working through this and other problems, you should be given another chance. Kurt seemed to have improved his approach to things over the last two years. This current charge, however, is very serious and can't be overlooked.

    3. Michelle Fishburn, nothing happened to "innocent until proven guilty." If Busch was innocent the judge never would have issued a restraining order. Busch has no one to blame but himself - he is a proven monster unworthy of sympathy.

    5. Monkeesfan You are so wrong a protection order is more or less a rubber stamp item for a woman in a Delaware court. The court would rather ere on the side of providing a protection order and find out that it was not needed than not issuing one and finding out that it was needed. About the ONLY time a protection order is not granted is when it is i conflict with state law. Such a protection order to keep one parent away from the kids when state law states that the parent has a right to see their kids. The rubber stamping of protection orders was proven by the fact that she was CAUGHT RED HANDED in court giving false testimony in the protection order hearing. Yet still got the restraining order even those the judge ruled no actual proof existed to support either side.

    1. You do know that the police came to the scene investigated the case and found nothing to support charges. No one was arrested on the scene. The case was sent to the DA with NO RECOMMENDATION for indictment. You are assuming facts not in evidence.

      Oh yea did you miss the part where she was caught presenting false testimony in court? So we know that she is not beyond lying in this case.

  18. Total and complete BULLSHIT. The claim may or may not be true. That is not NASCAR's job to decide. ALL that has been done so far is a restraining order has been issued. And according to the court she was caught lying in her testimony in getting the restraining order yet it was still issued. NO CHARGES HAVE EVEN BEEN FILED. NASCAR has become as PC as everything else these days. If it is proven in court he did this then suspend him. Until the STAY THE HELL OUT OF IT. It is none of NASCAR's business. It is a legal matter and it should be handled in the court of law. NASCAR has decided to throw out everything it was built on. American beliefs that a man is innocent until proven guilty. This is no different than the police kicking down your door taking you to jail and keeping you there until you can prove you did not commit a crime.

  21. To all you people going off on "political" tangents, take a look at NASCAR regulations that state that a driver may be suspended if he or she brings negative attention to the sport. Same goes for all sports. That is all Kurt Busch does, bringing negativity to NASCAR. Sad truth. Good driver, terrible excuse for a man. And for those who really believe this is "wrong", read above once again, and realize how stupid you look.

If Kurt Busch didn't do it then he would show that - the fact he's authored NO credible counterargument, instead spewing vitriol, merely proves anew the court issuing the restraining order has facts on its side and Busch does not. Busch has no one to blame but himself, and being exiled from racing is merely poetic justice.

  22. I am baffled that people will defend someone in the face of fact showcasing that person to be reprehensible and not worthy of support. Last year people made excuses for Tony Stewart instead of face the fact he ran over another person and had NO justification for it; now a judge rules that evidence indicates Kurt Busch was abusive to another person and that it warrants punishment - and Kurt Busch never authored any kind of credible case that he didn't do it, he just scattered vitriol - then NASCAR - having waited longer than other sports bodies by waiting for an official law enforcement decision - acts on that, and people defend Kurt Busch?

    I do not understand what people are afraid of here. Kurt Busch's career is defined by bullying, crashes, buck-passing, derangement, all to a point where he even antagonized the most docile media in sports - the guy has no right to even be in a garage area. If Tony Stewart had been suspended for a year by NASCAR, would that have somehow been wrong? So why is it wrong to suspend Kurt Busch? The sport never needed him, and there isn't anything in his career to respect.

    1. Exactly where did you get your misinformation. The judge did not say any such thing. The ruling is that it was more likely than less likely that the incident did occur. Which means it was not proven one way or the other but if they had to guess then they are going to ere on the side that it might have happened. NO WHERE did the judge say that the evidence was there to say he did it. It is NOT Kurt's job to prove he did not do it. The FACTS are the woman did presented FALSE evidence in the case. This is documented in the report. But the court felt that it would be better to issue a protection order even if it is not needed than not to issue one and find out it was needed. . In case you cannot understand. In the majority of the cases a protection order is more or less a rubber stamp. The woman asks for it then it is issued. This whole case is about a protection order issued. IT IS NOT about criminal charges. The case was investigated by the police and sent to the DA with NO RECOMMENDATION for indictment. No one is defending Kurt as a person. They are defending due process and the concept that a person is presumed innocent in this country until proven guilty. That the world of political correctness has found it;s way into NASCAR. If you are going to come on here and berate people for their views you should at least get your facts straight before you do.

    2. What "misinformation?" Yes the judge indicated evidence supports that Kurt Busch was abusive to another person - even more damning is the factual emptiness of Kurt Busch's defense. The fact a restraining order was issued - which would not happen if evidence was insufficient - indicates Busch has a credibility problem. It manifestly IS Kurt Busch's job to prove he didn't do it - it's what truth is about, and he has provided no credible counterargument.

      If "the woman" (a sign of a failed defense is refusal to give the name in question) gave false information then no restraining order would have come out. Period.

      Busch's whole history indicated what he is long ago - he treats everyone, on and off the track, as someone to be bullied. "No one is defending Kurt Busch as a person." False - the fact people are protesting his suspension IS a defense of him as a person, and the fact you're using that caveat proves you don't even believe your own argument.

      Busch has no right to ever appear in a NASCAR garage again. Period.

  26. We have have come full circle, twelve years later. I find it laughable all of these people crying about Kurt's suspension. I guess these people forgot how Kurt's lies caused Jimmy Spencer to lose sponsorship and UltraMotorsports to fold up shop. All because he couldn't back up his mouth and the fight HE started ON the track at 200 mph as was backed up by radio transcripts.

    Oh, he wasn't alone, Jack Roush willfully participateed in the lie. Now, no one will drive for him, and he is struggling too. Even the Wood Bros. pulled their alliance! I find it all quite amusing, and satisfying that justice is FINALLY being served for that farce committed in 2003.

  28. That is unfortunate and wrong. I do not excuse domestic violence... But this is ridiculous. Driscoll was in his race trailer, she lied to police, the police file no charges and Busch has to run away if she decides to attend a race or chooses to show up anyplace he may be. This along with indefinite suspension is justice? Give me a break. No, give Kurt Busch a break! He's due.

The whole incident in 2003, the run in with the Arizona law in 2005, the 2011 scrape with Dr. Jerry Punch, Joe Menzer in 2011, the 2012 incident with Bob Pockrass, we won't even get into the plethora of skirmishes with other competitors....."poor little Kurt", huh? Give ME a break!

  29. Let's look at a few items. First why the need for the restraining order if Busch was the one who ended the relationship? Why did she feel the need to present false testimony in the case? This was proven by the commission. She was guilty of presenting false testimony. Her job and political activities would have kept her away from the race track?. So why the need for the restraining order. Busch broke it off with her and not the other way around. So why the need for the restraining order?He was not going to be coming to Maryland and hang around where she worked. What we have is a politically connected woman who is out to punish the man who dumped her by destroying her life. Look at her background and you will see just how politically connected she is. So much so she can openly lie in court and not only not be charged with perjury but also get the restraining order she wanted but did not need. If Kurt had not of visited injured military personnel in the military hospital their paths never woudl have crossed anyway. So it is very unlikely they would come near each other. Her a DC socialite and him a NASCAR driver. The restraining order was never needed. So why get it and even lie to get it? NOW we hear she is going to go after other NASCAR drivers claiming she was not the only woman abused by NASCAR drivers and that it was covered up by teams.

    So this means Busch is again like so many times in the past bringing negative attention to NASCAR. All sports have the same attitude about negative attention. Karma is just catching up to Busch for all he has done in the past.
